Litigation on the urbanization of the former agricultural areas of the city of Cluj-Napoca in Romania

In this project we are advising Romanian and foreign investors who want to build a real estate project, but their investment is blocked by the new regulation on urbanism in Cluj-Napoca, Romania. It turns out that according to Decision 493/2014 of the Municipal Council of Cluj-Napoca, owners are arbitrarily prevented from building any form of buildings in lands newly moved from the agricultural area to the urban area of the city at least for the next 10 years.

In this case, the fact that these lands have been included in the urban area is by itself questionable, especially because the surroundings are stacked with buildings and industrial plants, and there is direct access to the supplies.

The reason behind the immobility of public authorities could be the desire to comply with European regulations on the conservation of green areas,

but the audacity of the decision lies in the fact that the zones in question are not even appropriate for the construction of parks since they are pastures without any agricultural or environmental value.

The lawsuit was filed before the Cluj Court through an administrative appeal and is in the procedure prior to the start date in the court.
